I really want to leave my husband, but leagally can I leave the state with my child or what are the laws on that? My baby is about to be born and I have to leave because he is a control freak that refuses to get a job what should I do?

He could keep that child in the state and if you leave against his will to have the child with him you'd be violating the law and could loose custody very quickly.
Get a divorce first. By the way, you would probably get the custody anyway, , because the law favors the mother with very few exceptions, and also you can prove that he is not able to sustain the child.
I don`t recommend you the "father unknown" option. On the long term, it will probably cause you troubles.
And there`s one more problem: even if you get the divorce, the law enforces a geographical restriction, which means the kid`s primary residence can not be changed outside a specific area without losing the custody. Usually they set the limits up to the county you live in and the contiguous counties.
Shelters are little likely to accept you unless he is violent or can be considered a bad influence in the raising , education and wellfare of the child.
You can not prosecute him for being unemployed.
Maybe , in the future, you can divorce and use the "unworthy parent" thing to get the custody and get rid of any restrictions.

I disagree with the first 4 answers. Until/unless a court enters a custody order, you are free to take your child with you anywhere you like...even outside of the U.S. (assuming you meet passport/visa requirements). It is true that a court might later consider your taking the child and leaving the state to be bad parenting, and might count it against you in a later custody determination...but until a court enters an order, you're free to go where you like with the child. WARNING: your husband is free to take your child and go where he likes, too.
Sugar, you don't deserve to be in that situation. You can leave him now or later. If he's really bad to you, leave now. If you must leave him after, do it quickly. Cross the State line before birth. List Father unknown. Freaks who will not work will never change. Your child deserves better. So do you.
Call the dept of social services and see what they advise. Also call the legal aid office to see what your rights are in such cases.
Protect yourself AND your baby.
Seek a Women's shelter and they will help file to get a temporary restraining order. Leave! It will only get worse.
Oh, you mean to say that 9 months ago, when you decided to make a baby with him, your husband was a sweetheart? Nice move lady, creating a baby with a bum and now your baby's not gonna have a dad.
