Well here's the story to this:
I was looking to get a bigger hard drive for my 360. I've been looking for a while for someone selling a hard drive on craigslist, and when I finally found someone selling one, it turns out they're lying.
I had a 13GB hard drive already for my 360, and the guy said the one he had been selling was a 60GB hard drive. Turns out it was just another 13GB drive. (I know because when I put it into my Xbox. I went to the memory settings and right there it says it's a 13GB drive.)
Now I've been trying to get him to give me my money back, but he's saying no, because he gave me a great deal. I'm saying that it wasn't a great deal because it WOULD have been a great deal IF it was a 60GB drive. Not a 13GB one that I already had. He's even trying to tell me that he was selling it for one of his friends, and that his FRIEND is lying. Personally I don't believe him about that.
Now am I stuck with this? Or can i sue him for lying about what he was selling?

You can sue this person in small claims court and you'll probably win. The fact his friend lied to him is not your problem. He can turn and sue his friend if his friend swindled him out of any money.
When you win, you have to return the hard drive he sold you and he owes you your money back. I'd also sue for court costs too. the fact he gave you a great deal is irrelevant. You don't need a 13GB hard drive. You already had one. Even if he gave it to you it would still be useless.
Probably not, since you bought this off of craigslist. It wouldn't be worth the cost anyways. Why didn't you check it out before you bought it? Hard drives generally say how big they are on the sticker. Call it a loss and learn the lesson. Always make sure that you actually agree to the price and that you are receiving the item described before paying.
You may be able to take him to small claims court. You may have to pay a court fee. For the value of the hard drive, It's not worth paying an attorney to actually sue the guy.

no legal recourse, but nothing says a little street justice isn't warranted. I'm thinking one or two flat tires is about right. with some egg action on a hot day.
In a kangaroo court of peers. There is no way you will recover the cost of 'taking him to court' otherwise.

Yes you can sue him. Take him to small claims court, then you'll only lose out on fees and court costs.
It depends if you have proof. Did you get a receipt detailing what you were supposed to receive? If not, let this be a life lesson.
I'm not sure if you could sue, but you could definitely bring the authorities into it if you wanted a refund.
