Can an employer legaly not promote because you cann't drive?
If the employee has a disability that prevents them form leagly driving can their employer legaly not promote that perso? And would that go againts an equal oppertunity employer policy?
Does the job that the person would be moving into require a driver's license? If so, the person does not meet the minimum qualifications for the new position. Are there other positions in the company that would be promotions for which the person would be qualified? The Americans with Disabilities Act requires that REASONABLE accommodations be made for persons with disabilities; it does not require that employers ignore the minimum standards for a position to suit a person with disabilities.
What is the reason that the employer wants you to be able to drive? Do you just need a driver's license or official ID for admin purposes, or does the job require you to actually drive? If you don't actually need to drive in order to perform the job, the employer should work with you to find an acceptable alternative to a driver's license.

If being able to drive is a requirement for the new job, and the employer cannot make a "reasonable accommodation," it may be.
It would also depend on what the disability is. Best to talk to a lawyer that is familiar with employment law.
