I signed a contract with a roofer to let him replace my roof.
My insurance covered it, and I agreed to pay the roofer the full check I received from Nationwide.
After they finish, they send a certificate of completion to Nationwide and get the rest of their money.
I get home today and the roof is done, but NOT the correct color.
I placed the order over the phone, so I do not have a copy of the work order in my possession nor have I yet spoken with the roofer.
Since I'm not paying out of pocket, what is my recourse? What options do I have?
I DID pay a $500.oo deposit out of pocket for materials when I agreed to this.
Should I ask for that back?

First of all you should have insisted on viewing some actual roof samples prior to choosing a color. A lot of roof shingles are a blend of several colors. It could be that your roof is actually the color you picked out, but viewing from a small sample you did not get the full effect of what it would look like. If the color on the shingle packaging is the same as you picked out over the phone - *which I never would do - you are stuck with it.
And why you did not get a copy of anything that states the color I am lost on. You always have to have something in writing to prepare you for problems like this. You need something that says what color you ordered, and also grab a shingle wrapper that shows the color of the shingles they installed on your house. Maybe there is one left somewhere around the house. If you are sure you are in the right - you call Nationwide and tell them not to pay, if they just finished today they have not yet sent the certificate of completion. But, you better have something that states what color you picked out or you are sunk.
Next time - do not do anything over the phone or without getting a copy of the contract that states the exact color of paint,carpet,windows, and in this case your roof shingles
You did pay for it...just through your insurance. Not sure how you ordered over the phone but you should have a written contract.First ask your contractor for a copy of the contract. The contract should have a title of the color on it along with the manufacture name. Keep in mind sometimes the printed sample or website sample will not always appear the same in person. www.AffordableRoofingFL.com has a great selection of manufacturers and colors to compare. If the color is similar contact the manufacture and ask for a sample sent to you for comparison. Sometimes the hue is different due to manufacturing. If by wrong color you mean you ordered “red” and you got “blue”. The only recourse you will have is what is in writing. Lesson learned don’t order a roof over the phone get it in writing. Sorry :(
First contact the roofer and ask why they did the wrong color. Try to get the issue sorted out with them. Don't try to get your money back from the deposit just because you don't like the color, that would be irrational at this point when you havent even talked to them about it yet. Check the contract you signed, you should have a copy of it because you signed it (even if you don't have the work order).
