Okay, so I sold my VW Beetle Turbo 1.8 for $6,200.00
They paid me $5,000.00 up front and still owe me another $1,200.00.
The deal was (as wrote and signed on paper by me, my husband, and the buyer) when the title comes in the mail we will exchange the title for the $1,200.00.
The car ran just FINE when I was driving it every day to work.
She says she had to put money into the vehicle, so she's not paying me anymore money
and she just expects me to give her the title.
We specifically SIGNED and DATED on a piece of paper an agreement that says
we will exchange the title for the $1,200.00
She test drove the car twice, and we waited for her to leave the parking lot we met in before we left.
I even negotiated with her we would take only half the $1200 that they still owe us. She said no.
A week and a half later now, we told her to either meet up with us to exchange the title for the rest of our money, or we are going to take legal action.
She told me "We don't want the car anymore, the only thing we are meeting up to exchange is the money that we already paid for the car"
Well, the day she wrote us the check for $5000, we had deposited it right away to PAY THE CAR OFF so we could receive the title to give to them. We have NO way to retrieve the money, the car was paid off the day they wrote the $5000.00 check and they knew that. So there's no way I can just go get my car and give them $5000.00 back. I even tried to be nice and say I'd accept just $1000, instead of $1200 like agreed... and she said NO.
Then I asked if we could at least meet back up to get my plates off the car, and she told me NO, she wasn't meeting up with me because she didn't "want" to. So I called the police and they went and got the plates from her. She told the police officer she couldn't meet up because her child was "sick".. not sure what the real reason was, but I do know she didn't want to give me my plates.
And I do know for next time to make sure I have all the money up front before handing the car over but the title took time to come in the mail, so we agreed we'd accept $5,000.00 JUST until title came.
I filed for small claims. It costed $170...
What does it sound like is going to happen? Does it sound like I will get my money?

Also, a day after I filed, I got something in the mail saying that she filed as well, so now we BOTH filed... I am so confused...!!??
She LIED and said the "$5000.00 was ONLY collateral to keep the car for the weekend" when really she SIGNED our agreement saying she'd give us the remainder of our money when the title comes in the mail. I just don't understand what happens if we BOTH filed.. How are they even suing me? I did nothing wrong? They just don't want to pay for the car!! This is SO stressful for me.

Ok the judge is going to look at your agreement and prob laugh at the lady who wants to sue you. If this is all true I don't see where you went wrong except for hand over the car before it was completly. Paid for. I don't think she can do anything because this was a set in stone sorta agreement you have the papers.. she took the car AS IS... if she had to put money in it she should have thought about that before... it can go good or bad but I think it will go good for you. I'm not.a lawyer... but its pretty easy to figure out that there's really nothing she can do.. good luck don't be worried everything will work out as its suppose to
well if she had no other means of transportation then she couldn't of driven the car to meet you and then tried to get home since no plates on the car. yes she is giving you the run around. be ready for all kinds of B.S from her just don't react to it just quietly listen. had to go to court on a similar matter years ago (only a dealer was my problem i won) and just listening to the stuff going on that day i'm surprised the judge didn't jump out the window. yes she has the right to file too. judge now has the final decision
