A tree fell from my neighbors yard and is hanging over my driveway. I can't get in without scraping up my car. he says he will fix in when he has time and strictly told me not to touch it since it is his tree. Should I cut it out of my way so I can get in or can he take legal action against me if I do? I say this because he is the guy that will cause any trouble he can and likes to piss people off.

your property is yours including air above your free to trim back any limbs or roots that cross the line horses but is horses but here in texas he cant leave his tail over the fence if it is expected to get any longer, its civil but cop will be glad to explaine it if called
I would definitely cut whatever part is keeping you from safely entering and exiting your property. He can do or say anything he wants but the fact is he's invading your space. I agree about calling the city and having them take a look at it. But until then, either clear your property yourself or have it done and send him the bill. I've lived next to a jerk like that before and it took an out and out confrontation to get him to mind his own business.
Inform him you are cutting the tree out of your way today! He has the choice of removing it or paying the tree removal bill...the tree is his responsibility, not yours..and if his fallen tree is blocking access to your house, you are within your rights.
Call the police and ask them to come out, talk to your neighbor as to his responsibility in the matter...BUT in no event, is the tree's removal your cost!

Hi Jeff........This is the sad part of this world..........You are offering to do something good for both of you and he's going to give you crap about it. Do you live in a wood burning area, maybe he wants the fire wood. My self, I would cut up what is necessary to get in and out of your yard...........but only if the tree is damaged. He may be thinking of trying to pull it back up and brace it. But if it is truly down.......then I would remove your part of it. Leave him the wood stacked up........so that you aren't in the wrong there........but know one has the right to land lock someone else........I do know that........all the best to you.
If he's the sort to get legalistic, reply in kind.
Tell him you can & will take action if it's not promptly seen to.
if there is any problem contact your city or town public works shop, they will either get him to remove it or remove it and send him a bill
